Korupsi si Mahathir?

  Featured

Written by  Chronicle Mailbag
Ketiga-tiga anak lelaki anda mempunyai harta bernilai 8 bilion USD.
Anda berkata kebijaksanaan bukan milik orang Barat sahaja.
Begitu hebat senarai salah laku anda

Rafizi's arrest bblow to Najib's anti-corruption credential

PKR Strategy Director has been charged in the Shah Alam sessions court this morning for allegedly breaching the Banking and Financial Institution Act when he exposed some of the worst abuses by National Feedlot Corporation (NFC).
Rafizi has led the charge to expose a long list of wrong-doings by the company and its directors, who are the husband and children of Datuk Seri Shahrizat Jalil, the recently resigned Minister of Women, Family and Community Development. Datuk Seri Shahrizat is still the Chief of UMNO’s Women’s Wing.
Despite the overwhelming evidence exposed to date, only Datuk Seri Shahrizat’s husband, Datuk Seri Mohamad Salleh has been brought to court, and even then only on 2 key charges – for misappropriating RM40 million of NFC’s money, and for acquiring 2 units of luxury condominium in One Menerung, Bangsar, Kuala Lumpur for RM13.5 million.
This is despite the fact that based on NFC’s last audited accounts, more than RM110 million has been misappropriated by the directors to set up a global chain of companies under their individual names. In addition, Rafizi has also exposed the fact that Datuk Seri Shahrizat’s family has acquired 3 luxury condominiums in Singapore worth some RM45 million, as well as a villa in Kazakhstan.
However, none of these assets have been frozen by the Malaysian authorities and none of the other directors have been charged despite holding various key positions in NFC, including the son, Izran Salleh who is the Chief Executive Officer of NFC.
Instead of pursuing the culprits who have abused the RM250 million government soft loan extended to NFC, the Government has chosen to exact revenge on the whistle-blower Rafizi Ramli who play the integral role in uncovering the lid on the litany of gross abuses by Shahrizat’s family.
The act by the Malaysian authorities marks a serious blow to the purported anti-corruption campaign launched by the Prime Minister Datuk Seri Najib Razak himself, under the Anti-Corruption National Key Result Area (NKRA) in the Government Transformation Programme (GTP). The spirit of the Whistleblower Act which was passed in December 2010 to encourage more to expose corrupt activities is clearly undermined with the persecution of Rafizi.
Only a week ago under the GTP2.0 Open Day, only 7 persons have sought protection under the Whistleblower Act today after more than 18 months, clearly pointing towards a complete lack of confidence in the Barisan Nasional government. Rafizi’s persecution will mark the death knell for the Act as no whistleblower will have any trust in the system to protect their interest.
The complete lack of urgency to bring criminal charges against Datuk Seri Shahrizat’s family members, and the speed at which Rafizi is being charged for blowing the lid on the scandal proves that Datuk Seri Najib has no qualms in protecting the powerful in Barisan Nasional, and quashing his political enemies. Such blatant abuse of power will only confirm in the eyes of the world that Najib’s reform agenda is pure hogwash.
We in the DAP will stand firm and together with Rafizi to ensure that truth and justice will prevail. Our leaders may have been detained without trial, sent to jail on trumped up charges and sued for defamation but we are committed to remain steadfast to our principles and will continue to fearlessly expose all misdeeds and wrongdoings committed by the BN leaders, their associates and cronies.

RAFIZI ARRESTED

after George Kent awarded LRT deal: Scorpene fear grips Najib?

Written by  Wong Choon Mei, Malaysia Chronicle
In a move that many believe will backfire badly on Prime Minister Najib Razak, his government arrested PKR strategy director Rafizi Ramli for exposing financial details in alleged contravention of the Banking and Financial Institutions Act.
Rafizi, a member of the PKR party led by Opposition Leader Anwar Ibrahim, had in recent months exposed the RM250mil NFC corruption debacle that led to the husband of former Women's minister Shahrizat Jalil being charged for criminal breach of trust.
His red-hot revelations had the Umno-controlled media baying for his blood and calling on the police to arrest him for allegedly breaching banking confidentiality rules.
However, Rafizi and other leaders suspect the arrest was more to do with the Ampang LRT deal in which a crony of Najib's was just awarded the billion-ringgit contract despite being the least qualified tender candidate in terms of experience and technical know-how.
"I am now arrested under the Banking and Financial Insitutions Act (Bafia) and will be taken to court right now," Rafizi said on Twitter.
"My 1st reaction at being arrested: Damn GeorgeKent. @NajibRazak must surely love his golf buddy to risk this public relations mess."
Also arrested was Johari Mohamad, a former bank staff. Both men were charged under Section 97(1) of the BAFIA and both pleaded not guilty.
The charge sheet stated that Rafizi had disclosed four customer account profiles detailing the balance summary for the National Feedlot Corporation Sdn Bhd (NFCorp), the National Meat and Livestock Sdn Bhd, Agroscience and Industries Sdn Bhd and NFCorp chairman Salleh Ismail, to two individuals identified as Yusuf Abdul Alim and Erle Martin Carvalho.
The trial is set to start on September 10. If found guilty, Rafizi could be fined a maximum of RM3 mil and jailed up to three years, which would destroy his chances of standing the next general election, widely expected to be held soon.
Corruption and the Scorpenes link
Rafizi had also accused Najib of using George Kent Bhd, a firm run by his close friend Tan Kay Hock, to obtain the Ampang LRT deal and at the same benefit Thales, a European conglomerate also participating in the tender and on allegedly preferential terms.
DCNS is the vendor of 2 Scorpene submarines ordered by Najib in a deal estimated to be worth at least RM7.3 bil and in which Najib is accused of accepting a bribe from DCNS to seal.
DCNS is now on trial in the French courts for allegedly paying illicit kickbacks to Malaysian officials including Najib worth at least RM570mil or 114mil euros.
Apart from Thales, Rafizi had also unraveled a chain of transactions and scenarios alleging how George Kent stood to benefit from being the middle-main in the deal. According to Rafizi, George Kent would farm out the contracts and earn commission from these. Thales would also be amongst the main beneficiaries.
The PKR leader had made his revelations even before George Kent was confirmed as the tender winner. Najib had denied his allegations but Rafizi then revealed the minutes of a meeting held by the Finance ministry's procurement unit. The minutes showed Najib - who is also Finance minister - had personally chaired the meeting that approved George Kent for the deal.
Shock at how the whistle blower is punished and not the wrongdoer
Meanwhile, civil society leaders and prominent citizens expressed shock at Najib's "desperate" move.
"The nation is watching! We stand by those brave enough to expose wrongdoing and condemn those who suppress the truth!" Ambiga Sreenevasan, the co-chairman of the Bersih movement for clean polls, said on Twitter.
"We knew it was coming but why the sudden rushed timing. Was it coincidental with the George Kent news? This is Ramadan, a fasting ad holy month to observe restrian and righteousness," PAS MP for Kuala Selangor Dzulkefly Ahmad told Malaysia Chronicle.
"But Umno seems so desperate it is committing blunder after blunder. We also note that such hypocritical action is coming from Najib who has been promising reforms and a clean government."

The myth of Malay Supremacy

Umno and Population Engineering:

Written by  Hussein Abd Hamid
Since 1957 UMNO has effectively carried out the population engineering of our country to ensure its long-term survival by creating the myth of a two pronged “Ketuanan Melayu” (Malay Supremacy).
“Ketuanan Melayu” for the Malay masses who are lull into a feeling of being superior over the non-Malays because of their numbers and “Ketuanan Melayu” for the UMNO Malay political elites through the accumulation of massive material wealth for themselves and their cronies.
And while UMNO has failed by almost any measure you chose to gauge them – good governance or morality – without question they have succeeded too well in the engineering of the population of this country of ours.
The duplicity of UMNO in proclaiming Satu Bangsa, Satu Negara while all the while undertaking a relentless program to whittle down the numbers of the non-Malays through very precise and focused initiatives is breathtaking in its effectiveness!
Consider this:
In 1957:
– 45% of the population are Chinese.
– 12% of the population are Indians.
In 2010
– 25% of the population are Chinese.
– 7% of the population are Indians.
Over 600,000 Chinese and Indian Malaysians with red IC were rejected repeatedly when applying for citizenship and possibly 60% of them had passed away due to old age.
Since 1957:
– 2 million Chinese have emigrated.
– 0.5 million Indians have also emigrated overseas.
– 3 million Indonesians migrated to Malaysia to become Malaysian citizens with Bumiputra status.
Now the non-Malays are well aware of this tinkering and engineering of our population and it would do us Malays no good to say that it was UMNO doing and that we had no hand in what happened. As a Malay I was then comfortable that UMNO was the dominant partner in the Barisan Nasional.
It was comforting to know that Malays controlled four of the five major banks.
Education? Between 1968 to 2000:
– 48 Chinese Primary Schools closed down.
– 144 Indian Primary Schools closed down.
– 2637 Malay Primary Schools were built.
Of the total government budget for these schools 2.5% were for the Chinese Primary Schools, 1% for the Indian Primary School and 96.5% for the Malay Primary School.
Petronas Petrol Stations? Of the 2000 station the Malays owned 99%.
Yes, we Malays were indeed in control. In control of what?
We were in control of the all the business licenses and permits for Taxis and Approved Permits.
We were in control of Government contracts of which 95% were given to Malays.
We were in control of the Rice Trade through Bernas that bought over 80% of Chinese Rice Millers in Kedah.
We were in control of UMBC, MISC and Southern Bank – all previously owned by Chinese.
We were in control of bus companies. Throughout Malaysia MARA buses could be seen plying all the routes. Non-Malays were simply displaced by having their application for bus routes and for new buses rejected.
Every new housing estate built had a mosque or a surau. None, I repeat “no” temples or churches were built for any housing estate!
Still unable to stand tall - why?
So why with control over all these highly visible entities and business opportunities are the Malays still unable to stand tall and with pride over and above the non-Malays? We are unable to so do because it was not the Malays that benefited from these opportunities- UMNO did.
Why must UMNO constantly harp about the need to spoon feed the Malays – about ketuanan Melayu when it is already in place and about Bumiputra status and all the privileges and rights that goes with that status?
And as a Malay I want to ask the non-Malays why do you still choose to live in a country whose government has by its actions and deeds done whatever it could to make you not feel welcome? The non-Malays I know have all told me the same thing – Malaysia is their country – they know of no other country they can call their own. And so they stay and put up with the abuses.
The difference now is that there are enough Malays who are shamed by the antics of this Malay political organization called UMNO. There are enough Malays to tell the non-Malays that we feel your pain. We understand your frustrations and despair at not being treated as equals in a country you call your own.
And enough non-Malays have migrated abroad to cause our country to understand that their loss is another country's gain. A loss, which our country can ill afford to sustain.
Karma at GE-13
And more importantly all this ground swell of disgust and contempt at UMNO has manifested itself in a way these political idiots understand – losing our votes in the 12thGeneral Elections. Amen for that.
And so we wait for the 13th General Election which we hope will dish out the relevant karma for UMNO and its Barisan Nasional partners.
Meantime understand what they have done to us all – not only the non-Malays but also to the Malays and do not allow Barisan Nasional to play the race card and start their divide and rule antics on us anymore.

Christian campaigners hit out tax evasion

Posted: Tuesday, July 24, 2012, 11:49 (BST)
A Christian movement to end poverty has spoken out against tax evasion by wealthy people.
Micah Challenge is calling upon church leaders to hold the super-rich to account after a report by the Tax Justice Network suggested that up to $20trillion was being siphoned off by the world's wealthiest people into tax havens.
The movement says that Jesus would have hit out at such excessive greed, especially at a time when millions remain in extreme poverty and without access to basic health care.
The campaigners are urging churches the world over to raise their concerns with politicians.
"Once again the poor are paying the price of the greed of the wealthiest," said Head of Campaigns Amanda Jackson.
"These figures are horrifying and should make us angry, just as Jesus was angered by greed.
"The money being siphoned off to tax havens is more than the American and Japanese GDPs put together. Yet millions of the world's poorest are suffering. It is so wrong."
The report, The Price of Offshore Revisited, has been compiled by James Henry, tax haven expert and former chief economist at consultancy McKinsey.
He estimates that at least £13trillion ($20 trillion) has leaked out of scores of countries into secretive jurisdictions such as Switzerland and the Cayman Islands with the help of private banks, which vie to attract the assets of so-called high net-worth individuals.
London and some US states do not escape criticism for handling assets which could be used to reduce national debts.
Micah Challenge is backing the Exposed2013 campaign to shed light on corruption. The campaign, which launches in October, will petition the G20 nations to support a full and automatic exchange of tax information.
G20 nations will also be reminded of their promise to tackle banking secrecy and tax avoidance - something Micah Challange says could help the world's poorest.
Mrs Jackson added: "The Bible urges us to speak up for the poor and for those without a voice.
"Micah Challenge supports the call by Tax Justice Network for governments to act."

Rightly said.

The non Malays don't need puppets.

Yong raps 'backdoor, coward, Umno puppet' Tsu Koon
 By Queville To
KOTA KINABALU: SAPP president Yong Teck Lee has lashed out at former Penang chief minister Koh Tsu Koon for questioning his bid to fight for Sabah's autonomy.

The former Sabah chief minister said any semblance of respect that people had for Koh disappeared when he crawled into the Cabinet through the “back door” by becoming a senator.

“He had earlier said he would not want enter Cabinet via the back door. I resent being compared to him. Unlike him, I rejected the nomination as senator and ministerial-status envoy in June 2008.

"Koh called this 'arrogance'. I call it pride and honour… proud as a Sabahan who can say 'no' to Kuala Lumpur, honourable as a Sabahan who refused to be bribed,” he added.

Yong said Koh and him worked together and compared notes during their time as chief ministers (of Penang and Sabah respectively), and the latter, who is Gerakan president, was often bullied by Umno.

“He could only claim close ties with fellow Penangite (then deputy prime minister) Anwar Ibrahim as a way to boost his clout,” he related.

Yong recalled that at one function in Kuala Lumpur, he witnessed Koh being rudely scolded by a Malay government officer when Koh spoke in Mandarin with another leader.

He claimed to have also witnessed how Koh had lowered himself when begging the then Kedah menteri besar (Sanusi Junid) not to proceed with the airport proposal in the northern region (which presumably would compete with the Penang airport).
“Sanusi brushed Koh aside and walked away. Koh had to run after him. These are incidents that made me realise that the political DNA of national BN leaders is completely wrong. I resent being compared with Koh because he was a coward in dealing with Umno. Umno likes to have such puppets.

“There is no dignity, no mutual respect, no honour in the relationship between Koh and his Umno colleagues. It does not matter whether Koh changed his style from 'tai chi' to 'kung fu'. His political DNA is subservient to Umno,” he said.

'We lost Batu Sapi, but we kept our honour'

Yong further said Koh as well as Gerakan and MCA leaders could not understand why when he was Sabah CM, he could reject federal Umno directives such as the approval of a gaming licence in Sabah.

He added that he had also successfully rejected the extension to Sabah of the Local Government Act, the Employment Act, the Indah Water Sewerage Consortium, among others.

“On my part, yes, I have lost Batu Sapi. We knew the risks. Defeat was a real possibility. Today, our enemies are gleefully mocking me and other SAPP leaders. But we conducted an honourable campaign against all odds. We lost Batu Sapi but kept our honour.

“Koh lost his own seat, his Penang state and his honour and dignity. His final nail will be when he is betrayed by (former Sabah CM) Tham Nyip Shen,” he said.
In the run-up to the Batu Sapi polls, Koh took a swipe at Yong, saying the latter's track record as a former chief minister and state minister "is subject to questions".

NINA in UMNO..but rich : No Income No Assets but Rich

In UMNO there are many Malays who have become rich without working for it, without any business acumen and without any brains!

In UMNO there are many Malays who have been given lucrative business opportunities without any financial risks for them.
These are fail-safe cash cows with an iron clad money back guarantee - the government buys it back from you at a premium – not if you fail but when you fail!

But here is where UMNO has failed these Malays. Tajuddin Ramli, Amin Shah, Halim Saad…these are the top of the heap of failed Malay ‘businessmen’ who epitomizes those who benefited from selective government patronage and became part of the culture of greed now infused into many Malay consciousness.
These individuals have been given every assistance, every fail-safe option to succeed. And yet they fail.

And then there are those like Mahathir’s son, Mirzan:

)  whose ‘businesses’ have been kept afloat by billions of ringgits belonging to  the people and this son of Mahathir considers himself a businessman of considerable abilities - the new rich Malays.   Malays who are multi millionaires riding on the back of UMNO and the people’s money.   But at least this son makes a show of running a business empire- a diverse conglomerate that covers a range of activities – mostly legal!
But come on lah….what business empire?  Given the breaks he has had, even a monkey can live in clover without ever running out of bananas for the rest of his life!

Then we have Malays like the late Zakaria Deros, Muhammad Taib, Isa Samad, Shahidan Kassim and of course the infamous Khir Toyo.  These are the scums of the earth.  They do not even have the intelligence or decency to hide the wealth that they have stolen from the very people who have voted to put them in power.  The hastiness in which Khir Toyo had proceeded to display his stolen wealth after losing office fills most of us with stomach wrenching disgust.  But these are the people that UMNO has chosen to be leaders within UMNO.

But what is most damaging to the Malays are the many thousand of Malays who have been taught that money can be got by abusing the trust placed in them by other Malays.

A Ketua Cawangan gets a contract to build a primary school in his kawasan.  Without any knowledge of business he is given a business opportunity way beyond his capacity to manage.  All he knows is that he has to get someone… just about anyone…. who will take the contract off his hands and give him a handsome commission.

He makes the 20% to 50% commission off the contract price.  It does not concern him if the contract is successfully completed or not – what matters is how much he will make as commission from that contract – after all he has already spent the advance given to him by JKR to start the contract.  To him this is a good way of doing business.

And so UMNO teaches a Malay to do business without having any knowledge of the business that he does, without any working capital, without risks and certainly without any brains to be able to better himself by this business opportunity given to him by UMNO.

While all this is going on the wheeling and dealing is most intense in the corridors of power.  In Putrajaya and in the Government Ministries.  Not only by the Minister himself but also by all his staff – anybody and everybody with access to the Minister will make their money.

In Agriculture, Defense, Education, Trade, Energy, Water and Communication and the mother of all Ministries, The Ministry of Finance.  And do not forget the Government Agencies and anywhere else a ringgit can be made.   Hell there are money to be made even in Rela and the  Anti-drugs Agency!
All this orgy of making money makes these Malays cash rich. Wine, women and song…big cars, nice clothes are easy enough habits to acquire but it does not teach them how to keep the money or how to use the money to make more money. And their ability to make money remains as long as their Minister stays a Minister  – so make hay while the sun shines!

And so what does it do to these Malays?  They become parasites. Parasite “Somebody who lives off the generosity of others and does nothing in return”
What they earn is not enough to keep them in the lifestyle that they want to live up to and so they take from us. While we have to live on the wages we earn UMNO eagerly opens up many sources of illegal income for those that pledge allegience to the party.

These Malays are regarded by most Malays as the worst of the blight that UMNO has caused to the Malay race.  The presence of these Malays makes real all that UMNO leaders have been saying about the Malays.   That the Malays need to be spoon fed, that the Malays are unable to compete on a level playing field with the other races, that the Malays will always need Ketuanan Melayu or they will be no more Malays left in their own country!  This is certainly true of the Malays in UMNO but not of the Malays outside UMNO!

I shudder to think of what the future will hold for these people. Where will they go and how will they survive when UMNO is out of government?

We see a bit of the future for these people in the likes of Ibrahim Ali and Mahathir. They know nothing but politics. Without politics they do not have a life…….even when they are past 80.  But there are no more places for them within UMNO.
And so we see them do what they do now and they become a pain to us in a place where the sun does not shine!  Just think of the negative impact it will have on the country when this scenario is repeated thousand of times at various levels after the next general elections when UMNO is ousted!
The way things are for UMNO they know it would be a mistake to send a message to the other races that UMNO only looks after their own – but what choice do they have?

What we need to understand is that UMNO has a fragmented political reality with real power residing outside cabinet. The extent to which this power is exercised will depend on the Prime Minister of the day. Our history will show us that Tunku, Hussein Onn and Abdullah Badawi left office because of circumstances beyond their control.

Circumstance created by those outside government but within UMNO.  A weak PM like Najib will surrender power to this faction, or for the lack of a better word, to these warlords as and when dictated to do so.

Because UMNO has been identified with the Malays, UMNO’s problem is the Malay problem.   UMNO’s crisis is a Malay crisis.   And UMNO’s solution to their problem will also be a Malay solution.   UMNO wants to lead but its ability to lead will depend on whether their intention to change is sincere.  Whether it can be backed by positive change in the face of opposition from the powerful forces within UMNO that wants to maintain its present status quo.

I think not. UMNO is deceit.   UMNO is greed. UMNO is not our future!

As the Chinese says : “The harsh winter is gone and spring is around the corner” ….I think that spring is indeed around the corner for all of us.

We await the 13th general Election with much impatience!

Your rights.

KUALA LUMPUR, July 24 — Bersih 2.0 leaders whooped with joy after a High Court ruled the electoral reform lobby group is a legal society today, overturning Putrajaya’s order to outlaw it last year in a move likely to raise further its public profile in the run-up to key national polls due soon.
Prominent lawyer-activist Datuk Ambiga Sreenevasan, who co-heads the 82-member group, told The Malaysian Insider she was “delighted” by the court ruling today to quash the federal government’s declaration outlawing Bersih in July last year.
“I have just heard the good news that the learned judge of the High Court has quashed the order of the minister that had declared Bersih illegal. Naturally, I am delighted by this outcome,” she said in a text message immediately after the court decision.
“In my view, the decision accords with my understanding of the law in relation to the making of such decisions by those in power,” she added.

Ambiga, who is currently abroad, thanked her legal team and supporters for standing by the group, which has been persistently branded an outlawed group by the ruling Barisan Nasional (BN) coalition ahead of the 13th general elections that could see a regime change in Malaysia for the first time since independence in 1957.
Ambiga has also been singled out by pro-establishment personalities and repeatedly attacked over her vocal calls for the electoral roll to be cleaned of dubious entries before polls are called, now widely speculated to take place in September after the Hari Raya Aidilfitri celebration.
An Umno federal lawmaker had last month suggested in Parliament that the award-winning civil rights fighter be hanged for treason, capital punishment reserved for the most serious crimes. Sri Gading MP Datuk Mohamad Aziz’s remarks drew strong support from fellow BN MPs but was widely criticised by opposition legislators and civil society groups, sparking a national furore.
Bersih co-chairman, Datuk A. Samad Said, told reporters he was relieved the group had been cleared of its “illegal” tag.
“It’s a waste of time, energy and resources and the order saying we are illegal should not be made again,” said the national laureate who attended today’s court hearing at the Duta Court Complex here, in an immediate reaction.
In her ruling today, High Court judge Datuk Rohana Yusof said the coalition of civil societies known as Bersih 2.0, though not officially registered, can be considered a society under the Societies Act.
“The minister’s order is quashed because Bersih is a lawful society,” Rohana said.
Maria Chin Abdullah, who is among Bersih 2.0’s 14-member steering committee, told The Malaysian Insider the court decision vindicated the group’s push for electoral reforms.

“Instead of wasting public funds on suits against Bersih, they should spend more effort and give recognition to freedom of assembly and what the citizens who have come out to demonstrate for clean and fair elections have been calling for.
“That would be a democratic way of responding to the court ruling and to prove their commitment to electoral reforms,” she said, referring to the federal government that has initiated a civil suit against members of Bersih’s steering committee to claim RM122,000 in compensation for damage caused to public property in the national capital during the group’s latest rally on April 28 this year.
The government’s unprecedented suit has been fixed for case management on August 10 at the High Court.
Chin Abdullah said Bersih was still getting many reports highlighting various discrepancies in the electoral roll and cited as examples voters who say their voting stations have been switched without their approval while migrant workers have been listed as voters in the roll, creating doubt over its validity.
“These issues have to be resolved before the 13th general elections,” she said.
“The SPR does not seem to be moving on these issues,” she added, referring to the Election Commission by its more popular Malay initials.
The Najib administration had agreed to set up a bi-partisan parliamentary polls panel on electoral reforms last year but is seen to be dragging its feet in enforcing the measures.
The loose coalition of civil societies has led tens of thousands in public demonstrations for clean elections, drawing the world’s attention to Malaysia’s electoral process at a crucial chapter when Southeast Asia’s fourth largest economy is attempting to break through the middle-income trap and graduate into the ranks of first-world nations amid a global economic slowdown.

2. Don’t appeal court ruling, Bersih tells Putrajaya

KUALA LUMPUR, July 24 — Bersih 2.0 has urged Putrajaya not to appeal today’s court ruling on its legal status and instead return all the materials it confiscated last year when the group was declared unlawful.
The 84-member electoral reforms group also asked that the government withdraw all civil suits against it in court, saying it was a waste of public funds.
“We recognise that the government has a right to appeal today’s decision but for the sake of our country, we sincerely ask them not to pursue with an appeal and to drop all the civil suits against us.
“Instead, we hope that the government will take cognisance of the political realities in our country and deal with Bersih 2.0 as a legitimate representative of the interests and demands of the people for free and fair elections,” the group said in a statement from its steering committee members here.
The Kuala Lumpur High Court decided today to quash Home Minister Datuk Seri Hishammuddin Hussein’s order last year and declare Bersih 2.0, a coalition of over 84 non-governmental organisations, a legal entity.
In her ruling, High Court judge Datuk Rohana Yusof had said the coalition of civil societies known as Bersih 2.0, though not officially registered, can be considered a society under the Societies Act.
“The minister’s order is quashed because Bersih is a lawful society,” Justice Rohana said.
Prominent lawyer and former Malaysian Bar president Datuk Ambiga Sreenevasan and 13 of her colleagues in Bersih’s steering committee had in July last year filed a judicial review seeking to get the Barisan Nasional (BN) government to lift its July 1, 2011 ban against the movement.
We hope that the government will take cognisance of the political realities in our country and deal with Bersih 2.0 as a legitimate representative of the interests and demands of the people for free and fair elections. — Bersih 2.0
Hishammuddin had declared the movement unlawful, citing Section 5 of the Societies Act 1966 as investigations had shown that Bersih 2.0 was not a registered organisation and that it was creating unease among the people.
A widespread crackdown on its members and supporters ensued, resulting in the arrest of a whopping 1,600 people during and after the July 9 rally in the city.
Ten days before the rally, police officers had raided the Bersih 2.0 secretariat in Petaling Jaya, carting away with the group’s materials for the event.
“The authorities should now return Bersih 2.0’s assets and materials seized... ranging from computers, video cameras, yellow T-shirts, posters, placards, pictures and a members’ list,” the polls watchdog said today.
Bersih 2.0 held another rally on April 28 this year, coining it “Bersih 3.0”, and is currently being sued by the Kuala Lumpur City Hall for some RM351,000 in damages.
The government’s statement of claim lists 15 vehicles, mostly belonging to the police, that had to be repaired at a cost of RM122,000.The government also wants general damages, interest and a declaration that Bersih breached Section 6(2)(g) of the newly-passed Peaceful Assembly Act 2011.
Ambiga has countersued the government for allegedly violating her constitutional rights over the April 28 rally, saying the Najib administration had abused its power by ordering the police and DBKL to block the event from taking place at Dataran Merdeka.Prime Minister Datuk Seri Najib Razak had said when tabling the new Act in Parliament last year that it would be “revolutionary” and allow Malaysians to participate in public gatherings “in accordance with international norms.”
3. JI and reds claims meant to distract from crime issues'

The allegation by the Special Branch that communists and Jemaah Islamiah (JI) have infiltrated Pakatan Rakyat is merely a distraction from Home Minister Hishammuddin Hussein's failure to tackle crime, PKR vice-president Nurul Izzah Anwar says.
clip_image011

"These statements are meant to divert attention from the home minister's track record, for he has failed to tackle the rising crime rate.

"I urge that he performs his duties properly and not hurl such accusations in bad faith at the opposition," Nurul Izzah told a press conference today. She said the people should evaluate the minister’s track record, whom she said had released some 1,000 ‘hard core criminals’ held under the Emergency Ordinance and were later accused of contributing to a spike in the crime rate.

In the meantime, she said, Hishammuddin had mocked Internal Security Act detainees by saying that he would rather have lamb chops while they held a hunger strike.
'Move to villify Pakatan Rakyat'

clip_image013At the same press conference, Seputeh MP Teresa Kok accused Hishammuddin of using the police to make the communists-terrorists allegation in order to vilify Pakatan Rakyat.

“Hishammuddin used Special Branch officers to claim that communists and Jemaah Islamiah had infiltrated Pakatan Rakyat. After using the officer, he continued with the same statement.

“This gives the impression that he has ran out of political capital and has to revive old issues,” Kok said at the joint press conference of secretaries-general from Pakatan Rakyat parties.
Last Thursday, Special Branch's E2 (M) national social extremist threat division assistant director Mohd Sofian Md Makinuddin claimed that the opposition parties were infiltrated by
terrorists who wanted to become candidates in the next general election.

Hishamuddin later said that the infiltration has not yet become a
national security issue and that action would be taken if it posed a threat.Pakatan Rakyat has vehemently denied the allegation and challenged the police to name the infiltrators
. The police have not responded.
